Former attorney general Khamma Bahadur Khati has concluded his arguments in the first hearing of the writ petition filed against recognition of the Nepali Congress (NC) elected by the Special General Convention,
Khati’s primary claim is that when the Election Commission granted official recognition to the Special General Convention, the supporters of the previous Central Committee were not given an opportunity to voice their concerns or provide a defense.
"The Election Commission issuing unilateral decision after the dispute arose is contrary to the prevailing acts, laws, and our party statute," he told quoting his arguments before the bench. "Therefore, our request was to stop filing of nominations scheduled for January 19. Since that could not be stopped, we have requested to keep it in status quo."
He further argued that a leadership formed from an illegal general convention should not be allowed to issue election tickets. He stated that they have requested an interim order, noting that the Central Committee had updated its records on November 22, 2025 and had also registered the disciplinary actions taken against the then general secretaries and one joint general secretary with the Election Commission.
He mentioned that since there are still 40 days remaining, it would make no difference to keep filing of nominations in status quo. He emphasized that this is a matter concerning the entire organization, not just a specific individual.
The Election Commission had recognized the Central Committee elected from the Special General Convention called by 54 percent of the general convention representatives.
Following that decision, Shrawan Kumar Shrestha on Sunday filed a writ petition as a proxy on behalf of former NC president Sher Bahadur Deuba and acting president Purna Bahadur Khadka faction. Khadka had requested that the petition be filed and heard on the same day, but the administration responded that the demand was not in accordance with the law.
In the petition, the Deuba faction’s primary demand is to declare the Special General Convention illegal and dissolve the Central Committee.
The NC leaders have also requested the SC that if nominations have already been filed, they should be suspended and a new date be announced for filing nominations.
