The Supreme Court has ordered the release of Durga Prasai, coordinator of the Rastra, Rastriyata, Dharma, Sanskriti Tatha Nagarik Bachau Maha Abhiyan.
Hearing a habeas corpus writ petition filed by Prasai’s son, a bench of Justices Nahakul Subedi and Shreekanta Paudel ordered Prasai’s release from custody on Sunday.
The Supreme Court based its decision on the agreement reached between the government and Durga Prasai's group on Saturday. It said that the context has also changed following the agreement.
Previously, on Thursday, a bench of Justice Meghraj Pokharel had ordered Prasai to be produced in court within 24 hours and also issued a show cause order to the defendants.
Prasai's son, Nirajan, had filed the habeas corpus petition on Wednesday.
Nirajan had named the Kathmandu Valley Crime Investigation Office, the chief district officer of the District Administration Office, Kathmandu, the District Police Range, Kathmandu, and others as defendants.
Based on statements made by Prasai, police had arrested him from his residence in Bhaktapur late Monday night. His bodyguard, Deepak Khadka, has also been arrested.
