The Supreme Court has ordered the registration of a writ petition filed against the Constitutional Council's recommendation of Manoj Kumar Sharma for the post of chief justice.
A single bench of Justice Meghraj Pokharel ordered the petition to be forwarded to the Constitutional Bench, according to Supreme Court spokesperson and Joint Registrar Arjun Prasad Koirala.
Following the order, the petition filed by Advocate Gita Thapa will now be presented before the Constitutional Bench.
"Since this matter falls within the jurisdiction of the Constitutional Bench, and the application seeking to overturn the administration's rejection order must also be considered by the Constitutional Bench itself, let it be presented before the Constitutional Bench," the court order states.
Meanwhile, separate applications filed by Senior Advocate Dinesh Tripathi and Advocate Prem Raj Silwal against the administration's rejection order have been dismissed.
The Supreme Court administration had refused to register three separate petitions challenging the chief justice recommendation. The administration had put the applications against its rejection order on hold until the chief justice was appointed.
When the administration failed to register even the applications challenging the rejection, then-acting chief justice Sapana Pradhan Malla had directed Chief Registrar Bimal Paudel to register them.
However, the registration process for those applications moved forward only after the chief justice was appointed, leading to Monday's hearing.
