The Supreme Court (SC) has refused to issue an interim order on the writ petition filed by outgoing Nepali Congress President Sher Bahadur Deuba against the decision of the Election Commission.
Hearing the petition filed following the Election Commission's decision to grant official recognition to the Central Committee led by Gagan Thapa, who was elected through the Special General Convention, a single bench of Justice Sunil Kumar Pokharel on Tuesday declined to issue an interim order, stating that certain questions require resolution.
The outgoing Acting President of NC Purna Bahadur Khadka also attended the hearing on Tuesday.
The Election Commission had recognized the Central Committee led by Gagan Thapa that was elected by the Special General Convention. Shrawan Kumar Shrestha on Sunday filed the petition as a proxy representing Sher Bahadur Deuba and Purna Bahadur Khadka.
Khadka had requested that the petition be filed and heard on the same day, but the administration responded that the demand was not in accordance with the law.
In the petition, the Deuba faction’s primary demand is to declare the Special General Convention illegal and dissolve the Central Committee.
The NC leaders have also requested the SC that if nominations have already been filed, they should be suspended and a new date be announced for filing nominations.
