The Supreme Court has dismissed a writ petition filed against the inquiry commission chaired by Gauri Bahadur Karki, which was formed to investigate the incidents of September 8 and 9.
On Friday, a bench of Justices Manoj Kumar Sharma, Nahakul Subedi, and Shreekanta Paudel dismissed the petition filed against the commission.
The court also issued an order in the case. However, the details of the order have not yet been disclosed.
Advocate Bipin Dhakal had filed the petition on November 4, seeking to stop commission Chairman Gauri Bahadur Karki and members Bigyan Raj Sharma and Bishweshwar Prasad Bhandari from carrying out their work.
The petition argued that the appointment of an individual with prejudiced views as the commission’s chairman violated the principles of natural justice adopted by the legal system.
It further stated that Chairman Karki shared news reports and gave interviews related to the matter he was tasked with investigating, thereby violating the principles of fair hearing and presumption of innocence.
The petitioner had requested an interim order to prevent the commission’s chairman and members from performing any official duties until the final resolution of the case.
