The Supreme Court has issued a show-cause order in the writ petitions challenging the 10-point agreement between the government and Gen Z representatives.
On Friday, a single bench of Justice Tek Prasad Dhungana issued the show-cause order against the defendants.
Advocate Prem Raj Silwal, advocate Sudip Bhandari, and others had filed two separate writ petitions against the agreement. In the petitions, the Office of the Prime Minister and Council of Ministers and Prime Minister Sushila Karki were named as defendants.
The defendants will now have to submit their written reply within 15 days through the Office of the Attorney General.
The petitioners argue that the current interim government has no authority to enter into long-term political or structural agreements with far-reaching consequences.
They also seek an interim order prohibiting the government from implementing the provisions of the agreement until a final verdict is delivered, arguing that their implementation would cause long-term damage to the state structure and constitutional practice.
The Supreme Court has decided to hear arguments from both sides on whether or not to issue an interim order.
The court has summoned both parties for hearing and discussion on December 26.
Additionally, the Supreme Court has ordered the submission of the original file of the agreement published in the Nepal Gazette through the Office of the Attorney General, said Ayush Badal, one of the petitioners.
Senior Advocate Ramesh Badal, Senior Advocate Amar Thapa, Advocates Prem Raj Silwal, Rohit Ojha, Sudip Bhandari, and law students Ayush Badal, Abhas Regmi, among others, presented arguments during the hearing.
