The Supreme Court has refused to issue an interim order against the decision to impose travel restrictions on five individuals, including then-prime minister KP Sharma Oli.
On Friday, the bench of Justice Nripa Dhwaj Niraula sought a written response from the respondents through the attorney general within 15 days.
“The press release issued by the inquiry commission on September 28 stated that correspondence would be made with the authorities concerned to enforce the restriction preventing the individuals from leaving the Kathmandu Valley. However, the writ petition and the accompanying documents do not show that such a decision or action has already been taken by the authorities concerned, or that the parties concerned have been informed. Since the issue of the validity of the respondent commission’s recommendation will be decided during the final hearing and adjudication of the presented writ petition, there is no need to issue an interim order as demanded in the writ petition at present,” the court order stated.
The inquiry commission led by former justice Gauri Bahadur Karki has imposed a ban on former prime minister Oli, former home minister Ramesh Lekhak, former home secretary Gokarna Mani Duwadi, former chief of the National Investigation Department Hutaraj Thapa, and former chief district officer of Kathmandu Chhabilal Rijal from leaving the Kathmandu Valley.
Advocate Premraj Silwal had filed the petition, claiming that the decision was illegal and violated the right to live with dignity.
Advocate Silwal had sought a mandamus to annul the decision and to ensure that no one is restricted from now on, along with an appropriate order.
