The Kathmandu District Court has ordered the release of Rastriya Prajatantra Party (RPP) Senior Vice-chairman Rabindra Mishra on bail.
According to the court’s information officer Deepak Kumar Shrestha, a bench of Judge Taradevi Maharjan ordered Mishra’s release on a bail of NPR 300,000 on Tuesday.
Mishra had appeared before the court on Tuesday morning.
The case stems from a violent protest at Tinkune in Kathmandu on March 28. The District Government Attorney’s Office, Kathmandu, filed charges against Mishra and 60 others on May 25, accusing them of offenses against the state, criminal mischief, and organized crime.
Among them, 11 individuals were charged with criminal mischief, while the remaining 50 faced charges of offenses against the state. Only 39 of the 50 defendants were present in court when the case was filed.
Mishra also served as member secretary of the "Joint People’s Movement Committee" led by Nawaraj Subedi. He was arrested by police on the evening of March 28 following the incident.
His wife subsequently filed a habeas corpus petition at the Supreme Court. On May 16, a bench of Supreme Court Justices Kumar Chudal and Til Prasad Shrestha ordered his release on personal guarantee. Mishra was released on the guarantee of advocates Shyam Bahadur Shahi and Basanta Blon.
Police tried to contact Mishra before filing the case, but they could not reach him. As a result, the investigating officer at the District Police Range, Kathmandu, imposed fines of Rs 25,000 each on advocates Shahi and Blon. The two have since obtained an interim order from the Supreme Court to halt the enforcement of this penalty.
On Thursday midnight, a bench of Kathmandu District Court Judge Dhruba Raj Karki remanded Durga Prasai and six others to judicial custody, while ordering the release of 32 others on bail. Prasai was designated "People's Commander" by the Subedi-led committee before the March 28 protest.
Following the order, RPP lawmaker and General Secretary Dhawal Shumsher Rana appeared in court on Monday and was granted bail. He has already been released after posting the bail amount of Rs 300,000.
After his hearing concluded, Mishra appeared in court on Tuesday.
