The Supreme Court has upheld the decision to reject a writ petition challenging Biswo Poudel’s eligibility for the post of Nepal Rastra Bank governor.
On Tuesday, a bench of Justice Sapana Pradhan Malla upheld the Supreme Court administration’s refusal to register the petition against Poudel.
The petition was submitted to the Supreme Court amid talks that Poudel was set to become governor after he resigned as a member of the governor recommendation committee.
Advocates Pratibha Upreti and Bishal Thapa had submitted the petition to the Supreme Court on May 13, arguing that Poudel was ineligible to become governor. However, on May 16, the Supreme Court administration refused to register the petition.
Supreme Court Registrar Bhadrakali Pokharel dismissed the petition as “premature,” saying it was based solely on news reports and failed to clarify how collective rights were violated.
Justice Pradhan’s bench on Tuesday upheld the decision to reject the petition.
Upreti and Thapa had argued that Poudel, being a member of a political party, could not be appointed governor, citing his role as a Nepali Congress Mahasamiti member and his candidacy as a defeated representative in the House of Representatives election.
