The Supreme Court (SC) has refused to issue interim order in the the writ petitions demanding revocation of the vacancy announcement by the Public Service Commission (PSC).
The SC has said there will be no interim order in the two petitions filed by advocates Bikash Thakur and Jag Dev Chaudhary demanding revocation of the PSC's vacancy announcement claiming it is against the principle of inclusion.
A joint bench of Justices Hari Krishna Karki and Ananda Mohan Bhattarai has refused to issue interim order stating that over 400,000 persons have applied for the jobs and issuing one would deny them their rights to compete. "Over 400,000 including over 150,000 from inclusive group have applied in accordance to the advertizement and it is not appropriate and necessary to issue interim order through the public interest litigation in a way that restricts their rights to compete," the SC has stated.
Four writ petitions were filed against the vacancy announcement made on May 29. Three of those petitions demanded revocation of the advertisement while the fourth is in support of the vacancy announcement.
The joint bench of Justices Karki and Bhattarai are hearing all of those petitions.
The writ petition filed by advocate Rajaram Ghimire supporting the vacancy announcement demanded revocation of the instruction by the State Affairs Committee of the parliament to stop the recruitment process. The SC has said there is no need to issue any order on that petition.
It has also not issued order even in the petition filed by contracted staffers of the local level demanding revocation of the vacancy announcement.
The PSC on May 29 had announced vacancy for 9,161 staffers in the local bodies across the country.
A huge number of applicants applied for the jobs despite the registration of writ petitions and the instruction by the parliamentary committee.
