Deepak Raj Joshi, who was rejected for the post of chief justice (CJ) by the special committee for parliamentary hearing, has sent a welcome message at the start of implementation of the new General Code as an acting CJ.
Joshi's secretariat on Thursday sent a welcome message for implementation of the new General Code as an acting CJ and chairman of the Judicial Council.
"We cannot reach the destination of justice if the constitution and laws are not appropriately implemented and the malpractice of arbitrary interpretation continued no matter how many new constitution and laws are formulated," the message reads.
The special committee for parliamentary hearing on August 3 rejected Joshi for the post of chief justice. He has been on a leave since August 5.
Om Prakash Mishra has been constituting benches as the senior-most justice after that. Joshi himself delegated the duties to Mishra when taking leave on August 5. The website of Supreme Court also says Mishra is the acting chief justice while Joshi has been included only as a justice.
Many had expected Joshi's resignation after rejection by the special committee for parliamentary hearing. But Joshi chose to take leave.
He remains a justice and will remain one until he completes 65 years despite his rejection for the post of chief justice. He will retire in October 2019.
Joshi had become acting chief justice after Gopal Parajuli was relieved of duties by the Secretary of Judicial Council Nripa Dhwaj Niraula on March 14.
