The writ petition filed at the Supreme Court by the CPN-UML demanding the reinstatement of the House of Representatives has been registered.
The petition, submitted by UML leaders Mahesh Bartaula and Sunita Baral, was registered on Wednesday. They had submitted the petition on Tuesday.
The defendants named in the petition include the Office of the President, Prime Minister Sushila Karki, the Office of the Prime Minister and Council of Ministers, the Election Commission, and the Parliament Secretariat.
The hearing on the petition has been scheduled for December 3.
More than 16 petitions demanding the reinstatement of the House were registered previously, and preliminary hearings on them have also begun.
In the petition filed by the UML, questions have been raised regarding Sushila Karki's appointment as prime minister.
It mentions that Karki is not a member of the House of Representatives and that the Constitution itself prohibits a person who has already served as chief justice of the Supreme Court from becoming prime minister.
It further argues that Karki was appointed as prime minister in violation of Articles 76 and 132 (2) of the Constitution, and therefore the appointment is prima facie unconstitutional.
The petition demands the annulment of the president's decision to appoint Karki on September 12, Karki’s oath-taking, and other appointments.
Stating that the government itself is illegal, the UML has demanded the annulment of all its work, decisions, and appointments.
Additionally, it has demanded the reversal of Prime Minister Karki's decision to dissolve the House of Representatives.
The petition has demanded that the period after September 9 be treated as a void period, a mandamus be issued in the name of the defendants, ordering the reinstatement of the House of Representatives and the restoration of all state organs and bodies as they existed on that day to operate in their previous form.
It has also sought a mandamus ordering the formation of another government under Article 76 through President Ram Chandra Paudel.
Furthermore, it has demanded a mandamus ordering the speaker and the Parliament Secretariat to convene a meeting of the reinstated House.
