Former attorneys general have advised Speaker Devraj Ghimire not to personally file a petition at the Supreme Court challenging the dissolution of the House of Representatives.
Speaker Ghimire had sought their opinion on whether he should move the court demanding the reinstatement of the dissolved House.
Former attorneys general Bharat Bahadur Karki, Khamma Bahadur Khati, and Mahadev Yadav took part in the discussion held at Ghimire’s office in Singha Durbar on Thursday.
According to the speaker’s press coordinator Shekhar Adhikari, all three former attorneys general suggested that it was not necessary for the speaker himself to approach the court with a petition.
“All three said that it was not necessary for the speaker to go to court to file a petition,” Adhikari said. “They mentioned that cases have already been registered, lawyers will debate, and the court will collect necessary documents and conduct a constitutional review on its own.”
The former attorneys general also cautioned that if the speaker personally filed a case, it could lead to further attacks on political parties.
“Political parties are in a difficult position. The Constitution has been attacked,” they said. “There could be further attacks in a difficult security situation. Therefore, this is a matter for the court. The court will look into it.”
During the meeting, former attorney general Yadav expressed the view that fresh elections should be held.
“Elections will solve the problem,” he said during the discussion.
Meanwhile, former attorneys general Karki and Khati argued that the House of Representatives would be reinstated by the court, noting that current conditions were not conducive for elections.
“There is no environment for conducting elections,” they said. “Therefore, reinstatement of Parliament will happen automatically.”
Earlier, Speaker Ghimire held consultations with leaders of political parties on Wednesday. He is also holding discussions with legal experts regarding the matter.
