The Supreme Court has ordered the release of Sujit KC, coordinator of the National Democratic Youth Front, a sister organization of the Rastriya Prajatantra Party (RPP), on personal guarantee.
On Wednesday, a bench of Justices Balkrishna Dhakal and Nityananda Pandeya issued an order to release KC on personal guarantee, according to Supreme Court spokesperson Achyut Kuikel. KC has already been released following the order.
The order says that KC is unlikely to flee or tamper with evidence, making his continued detention unnecessary.
"Since no further investigation is required at this stage and no reasonable grounds for detention are evident, a habeas corpus order has been issued in the name of the defendants to release him on the personal guarantee of a reliable person and conduct the remaining investigation of the case," the order reads.
KC had written a Facebook post alleging that Jaybir Deuba, son of Nepali Congress President Sher Bahadur Deuba, had purchased shares of Hilton Hotel.
However, Hilton Hotel issued a statement clarifying that nobody had purchased shares of the hotel.
Following this, the Cyber Bureau of Nepal Police arrested KC last Friday and also obtained permission from the Kathmandu District Court to keep him in custody.
But the Cyber Bureau had not disclosed the grounds for his arrest. The Bureau had detained KC on the charge of violating Section 47 of the Electronic Transactions Act.
KC had then filed a habeas corpus writ petition against his detention.
RPP spokesperson Mohan Shrestha confirmed that KC was released following the Supreme Court’s order.
