The constitutional bench of Supreme Court (SC) has summoned the petitioner, who has been demanding for reelection in Dhanusha-3, and the Election Commission for hearing.
Rajendra Mahato of Rastriya Janata Party Nepal (RJP) had defeated Bimalendra Nidhi of Nepali Congress (NC) by almost 3,000 votes.
Left alliance candidate from CPN (Maoist Center) Ram Singh Yadav, who came third behind the two, has moved the court claiming that he lost the election due to a fake news by a local news channel claiming that the left alliance had agreed to support Mahato on the election day December 7.
The constitutional bench of five senior justices including Chief Justice Gopal Parajuli has summoned both the sides to the court on January 3 to decide whether an order needs to be issued on that or not. Election-related cases are heard by the constitutional bench of SC.
"A breaking news was broadcast claiming left alliance candidate Ram Singh Yadav has reached agreement with Mayor of Janakpur Sub Metropolitan City Lal Kishore Sah to support RJP. I was defeated due to the news broadcast during the silence period. Another result arrived due to the act done to influence the voters. Please do order a fair election again," the petition filed by Yadav reads.
Yadav had received 2,346 votes. Mahato had won by securing 30,750 votes to beat Nidhi who received 27,847 votes.
Similarly, the constitutional bench has also summoned both the sides for hearing on December 29 in the case filed by Deepak Khadka of NC seeking reelection in Sankhuwasabha for the federal parliament.
It has also scheduled the hearing on the petition filed for reelection in the provincial election of Tanahu-2 (A) citing rigging for January 3.
