The Supreme Court has refused to register a writ petition brought against former chief justice Cholendra Shumsher Rana, alleging that he had not signed the full text of the verdict on the dissolution of the House of Representatives even five years after the decision.
On Friday, Supreme Court Registrar Man Bahadur Karki refused to register the petition submitted by advocate Yagyamani Neupane.
Advocate Neupane had submitted the petition against Rana on Wednesday, stating that the full text of the verdict had not been released even five years after the decision. He had demanded a mandamus to prepare and authenticate the full text of the verdict.
“Since the preparation and authentication of verdicts are part of the judicial process and fall under this court’s extraordinary jurisdiction, the petition cannot be registered,” the Supreme Court said in a statement.
The court refused to register the petition, citing Section 128 of the National Civil Procedure Code and Rule 18 of the Supreme Court Regulations.
On February 23, 2021, the Constitutional Bench of the Supreme Court had ruled to reinstate Parliament.
The bench consisted of then-chief justice Cholendra Shumsher Rana and justices Bishowambhar Prasad Shrestha, Anil Kumar Sinha, Sapana Pradhan Malla, and Tej Bahadur KC.
The bench had annulled the decision to dissolve Parliament and ordered the convening of a Parliament session within 13 days.
At the time, President Bidya Devi Bhandari had dissolved Parliament on the recommendation of then-Prime Minister KP Sharma Oli. The Constitutional Bench had declared the dissolution unconstitutional.
