The Supreme Court has refused to issue an interim order on the writ petition filed by Hitendra Dev Shakya regarding his removal from the position of managing director of the Nepal Electricity Authority (NEA).
On Friday, a joint bench of Justices Abdul Aziz Musalman and Nripadhwaj Niraula declined to grant the interim order sought in Shakya’s petition.
“The substance of the mentioned cases and the facts and legal questions presented by the petitioner are similar. Since the constitutional and legal questions raised by the petitioner can be interpreted, analyzed, and addressed together with those cases during the final hearing and decision on this case, it is appropriate and necessary to decide all these cases together. Therefore, an interim order as demanded by the petitioner need not be issued at this stage,” the order states.
After the formation of the new interim government, Energy Minister Kulman Ghising removed Shakya from the post and appointed Manoj Silwal as NEA’s managing director.
Shakya had filed a writ petition in the court, claiming that the decision was against the law.
