The Udayapur District Court has ordered release of Supreme Court (SC) Justice Prakash Man Singh Raut's wife Lalita Kumari, her two elder brothers and wife of one of those brothers after 22 days in custody.
They were arrested on charge of Lalita Kumari trying to register son of her brother as her own. The court after ordering an arrest warrant and extending their judicial custody on multiple occasions finally ordered their release on Monday.
"Do investigate without keeping them in custody and send the file and collected documents to the Area Police Office Katari as there will be no obstruction in investigation if they are released on condition of being present when necessary," the order by the single bench of District Judge Tirtha KC reads.
Justice Raut's father had lodged police complaint after Lalita Kumari registered son of her eldest brother as her own. Lalita Kumari, her two elder brothers and wife of the younger of the two brothers were arrested after that.
Justice Raut and Lalita Kumari, who were married 14 years ago, do not have any kid. She claims that she registered the son of eldest brother as their own with consent of Justice Raut. But Justice Raut has been claiming that she has falsely registered someone else's son as theirs without his consent.
Lalita Kumari has gone to her parental home upon release.
The police will conduct additional investigation and decide whether to take the case to the court.
