The Patan High Court’s Hetauda bench has issued a show-cause order in a writ petition filed against the appointment of Kiran Thapa Magar as chief minister of Bagmati province.
A single bench of Justice Babita Upreti issued the order on Monday.
The court has also ordered the defendants to submit a written response explaining why the order sought by the petitioner should not be issued.
The court will hear both sides on August 26 to decide whether to issue an interim order.
RPP lawmaker Kumari Tamang had sought an interim order against the appointment of the chief minister.
Chief Minister Thapa Magar is preparing to seek a vote of confidence in the provincial assembly later on Monday.
There is an ongoing dispute within the RPP over the support to the chief minister and participation in the government.
The RPP has already removed its parliamentary party leader, Uddhav Thapa, and submitted a letter to the Bagmati Provincial Assembly’s deputy speaker confirming his removal.
Three RPP lawmakers are serving as ministers in the Bagmati government. Separate whips have been issued to RPP lawmakers in the province. The RPP central leadership has instructed lawmakers not to give the chief minister a vote of confidence and instead remain neutral or stay absent.
However, the ministers serving in the government and some other RPP lawmakers appear inclined to vote in favor of the chief minister.
