The Supreme Court has refused to issue an interim order in a writ petition filed by Kishori Sah Kamal, the Rastriya Swatantra Party (RSP) candidate from Dhanusha Constituency No. 1, against the decision of the Election Commission to cancel his candidacy.
A joint bench of Justices Binod Sharma and Meghraj Pokharel declined to grant an interim order in Sah’s favor.
Sah had filed a writ petition at the Supreme Court seeking to retain his candidacy. With the court’s refusal to grant an interim order, Matrika Yadav of the Nepali Communist Party has been declared the winner from Dhanusha-1.
The Election Commission had annulled Sah’s candidacy on March 2, citing that the Credit Information Bureau had placed him on a blacklist for liabilities related to banks and financial institutions.
His company, Kamal Nirman Sewa Pvt Ltd, had been blacklisted since February 5, 2024, for failing to fulfill obligations related to banks and financial institutions. Sah had filed two writ petitions related to the matter.
Initially, he moved the Supreme Court on March 3 seeking to overturn the Election Commission’s decision and retain his candidacy. The first hearing on that petition took place on March 9, during which the court scheduled further discussion for March 13. However, the hearing did not proceed on that day and was deferred.
Meanwhile, the Election Commission had already declared Matrika Yadav of the Nepali Communist Party as the elected candidate from Dhanusha-1.
Separately, on March 11, Sah filed another writ petition asking the court to prevent the implementation of the decision by Nepal Rastra Bank and the Credit Information Bureau to blacklist him.
Hearing that petition, Justice Sharanga Subedi earlier issued an interim order stating that a letter from the Credit Information Bureau indicated that Sah had not been blacklisted.
