The Supreme Court has issued a writ of habeas corpus in favor of Durga Prasai, coordinator of the Rastra, Rastriyata, Dharma, Sanskriti Tatha Nagarik Bachau Maha Abhiyan.
On Tuesday, a joint bench of Justices Manoj Kumar Sharma and Meghraj Pokharel ordered Prasai’s release, stating that his detention was unlawful, according to Information Officer and Deputy Registrar Nirajan Pandey.
Earlier on Monday, a bench of Justices Nahakul Subedi and Meghraj Pokharel had ordered the original file of the decision sent by the Election Commission to the police for action to be presented before the court.
"Since it appears the petitioner (Durga Prasai) was arrested following a letter dated February 15 from the Election Commission requesting investigation and action, produce the original file of the commission’s decision through the Office of the Attorney General," the court said in its order.
Prasai had filed a habeas corpus petition naming the District Police Range, Kathmandu, as the defendant.
In its written response to the Supreme Court, the police range stated that it arrested Prasai on February 16 in accordance with a letter sent by the Election Commission.
Following the commission’s letter, a team from the police range arrested Prasai on February 16.
