The Supreme Court (SC) on Monday has revoked the writ petition about eligibility of Chief Election Commissioner (CEC) Ayodhi Prasad Yadav.
A joint bench of Justices Kedar Prasad Chalise and Dambar Bahadur Shahi on Monday revoked the petition filed by Praveen Kumar Laabh arguing that a person who has already served one full term at the Election Commission (EC) does not qualify for re-appointment.
Yadav was appointed EC commissioner before the first Constituent Assembly Election in 2008. His first term expired six years later. Three commissioners including Neel Kantha Uprety, Dolakh Bahadur Gurung and Yadav were given a second term after expiry of the first term.
Laabh had moved the court after their extension. Uprety was appointed CEC and was succeeded by Gurung even as the petition was sub judice. Yadav succeeded Gurung after the latter retired due to age limit.
Yadav's second term will expire at the end of 2018.
