A habeas corpus petition filed on behalf of Durga Prasai by his wife, Uma Prasai, has been dismissed.
With the dismissal of the petition, the police investigation into the case against Prasai will continue while he remains in custody.
A bench of Supreme Court Justices Hari Phuyal and Meghraj Pokharel dismissed the petition.
The petition named Nepal Police Headquarters, the Cyber Bureau in Bhotahiti, Kathmandu, and others as defendants.
The Cyber Bureau arrested Prasai from his residence in Bhaktapur on September 28 following a complaint over allegedly objectionable remarks he made against Rachana Khatiwada, a lawmaker from the Rastriya Swatantra Party.
Meanwhile, Kathmandu District Court Judge Umesh Prasad Luintel ordered Prasai’s release on bail of Rs 200,000 on Tuesday, according to the court’s information officer, Shiva Prasad Khatiwada.
A case had been filed against Prasai under the Electronic Transactions Act, 2006, accusing him of committing an offense under the law.
