The Supreme Court has ordered that businessman Shekhar Golchha be produced before the court within 24 hours.
On Tuesday, a bench of Justice Nripadhwaj Niraula issued the order in response to a habeas corpus petition.
Golchha’s wife, Seema Golchha, had filed the petition on Sunday, claiming that her husband was being held in illegal detention by the police.
Responding to the petition, the court ordered the defendants to produce Golchha and submit a written response within 24 hours of receiving the notice (excluding travel time).
"Issue a notice to the defendants along with a copy of this order and the writ petition, directing them to submit a written response along with the detainee through the Office of the Attorney General within 24 hours of receiving the notice, excluding travel time. Once the response is filed or the deadline expires, summon the investigation file – under which the petitioner is said to be remanded for further investigation – and present it as per the rules," the court order states.
Golchha is currently in the custody of the Central Investigation Bureau (CIB) of Nepal Police on charges of committing offenses contrary to the Insurance Act in share trading, based on a report by the Nepal Insurance Authority.
On Monday, a bench of Justice Dandapani Lamichhane at the Kathmandu District Court had extended his remand, allowing the authorities to keep him in custody for three more days for investigation.
