CPN-UML Chairman KP Sharma Oli has alleged that the government was formed from outside the Constitution against his recommendation.
Presenting a political report at the central committee meeting that began at Rambagh Mahal in Lalitpur on Wednesday, Oli claimed that while he had suggested that a non-parliamentarian could be appointed as prime minister if necessary, he had recommended moving forward only through a constitutional process by amending the Constitution through Parliament.
On September 12, President Ram Chandra Paudel had said that he had appointed Sushila Karki as prime minister based on the recommendation and consent of caretaker Prime Minister KP Sharma Oli. However, Oli claimed in his political report that he did not recommend forming a government from outside the Constitution.
“Amid an extraordinary situation, after the prime minister had already resigned, we had presented constitutional alternatives to prevent further damage and to provide a way out of the state of uncertainty. Our clear and firm position was that even if it became necessary to appoint a non-parliamentarian as prime minister under difficult circumstances, it should be moved forward through a constitutional process by amending the Constitution through Parliament, by building consensus among the major political parties represented in Parliament, and that the House of Representatives should not be dissolved under any circumstances," Oli said. "I, as the caretaker prime minister, had accordingly recommendations for a constitutional way out. Contrary to that suggestion, a government has been formed from outside the Constitution. Therefore, this government is unconstitutional.”
Oli said that the dissolution of the House of Representatives is unconstitutional and undemocratic. It has left the country without a body of elected people's representatives and created a political vacuum, he added.
"It has weakened the sovereignty inherent in the people and encouraged anti-democratic forces. Our party expresses objection to the unconstitutional and undemocratic dissolution of the House of Representatives and emphasizes that the dissolved House must be immediately reinstated," he said.
