The Supreme Court has issued a show-cause order in a habeas corpus writ petition filed on behalf of Rastriya Swatantra Party (RSP) President Rabi Lamichhane.
A single bench of Justice Abdul Aziz Musalman issued the show-cause order on Tuesday.
The case was previously assigned to Justice Hari Prasad Phuyal's bench, which said on Monday that it could not hear the petition.
Lamichhane's wife, Nikita Paudel, had filed the writ petition at the Supreme Court on Sunday.
Earlier, a writ petition was filed at the Supreme Court demanding annulment of the order passed by the Butwal bench of Tulsipur High Court to remand Lamichhane into custody. Hearing the petition on April 13, the Supreme Court had ordered authorities to submit additional details.
Lamichhane is currently in custody at Rupandehi Prison.
The Rupandehi District Court had ordered Lamichhane’s release on a bail bond of Rs 10 million in a cooperative fraud and organized crime case involving Supreme Savings and Credit Cooperative.
However, the Tulsipur High Court overturned the district court's decision and ordered Lamichhane to be remanded into custody for further investigation on April 4.
