Bibeksheel Nepali on Wednesday moved the Supreme Court (SC) against the Election Commission (EC) for rejecting its application for party registration.
The party moved the SC against the EC's March 12 decision on its application registered on January 11.
The party said that it filed the writ petition at SC in order to correct the EC's decision. It also claimed that the EC's decision is unjustified and against law.
As per the details provided to the EC, Bibeksheel Sajha Party had a total 37 central committee members on the day of registration of the new party, and 16 (more than 40% of 37) of them applied with the EC for registration of Bibeksheel Nepali, the press release issued by the party reads.
The Bibeksheel Nepali claimed that the party is eligible for registration as it has more than 40 percent committee members as specified by clause 33 (2) of act related to political party. The EC claims said that the party lacks the requisite number of central committee members for party registration.
