The Supreme Court has issued a show-cause order in response to a habeas corpus petition filed on behalf of former prime minister KP Sharma Oli.
On Monday, a bench of Justice Meghraj Pokharel issued the order to the defendants.
Earlier on Monday, the court issued a similar show-cause order in the case of former home minister Ramesh Lekhak.
Oli’s wife, Radhika Shakya, had filed the habeas corpus petition at the Supreme Court challenging his arrest.
Similarly, the wife of former home minister Lekhak, Yashoda Lekhak, had filed a habeas corpus petition on Sunday, claiming that he was detained unlawfully.
An inquiry commission formed under former judge Gauri Bahadur Karki to investigate incidents that took place on September 8 and 9 last year had recommended investigation and prosecution against both Oli and Lekhak.
The recommendation was made under Sections 181 and 182 of the National Penal Code 2017.
Based on this report, the government decided on Friday to implement the recommendations.
Following this decision, police arrested Oli and Lekhak on Saturday morning.
On Sunday, the Kathmandu District Court granted permission to keep them in custody for five days for investigation into homicide-related charges.
