A writ petition has been filed in the Supreme Court against the verdict by the full bench including former Chief Justice (CJ) Sushila Karki ordering transfer of ownership of the land received in dowry by the then king Gyanendra Shah's daughter Prerana Rajya Laxmi Singh to the Nepal Trust.
Singh has moved the Supreme Court (SC) stating that her case should have been heard by the constitutional bench.
The full bench of justices including the then CJ Karki, justices Deepak Karki and Sapana Pradhan Malla had issued the verdict on January 5, 2017 ordering transfer of ownership of 15 ropanis and one aana of the land in Chhauni, Kathmandu to the Nepal Trust.
Former CJ Ram Kumar Shah and justice Cholendra Shumsher Rana earlier had ruled that ownership of the land owned by former king Birendra should remain with Singh as she had received it in dowry from Birendra's brother Gyanendra.
The writ petition filed by Singh mentions that the verdict by the then CJ Karki was an injustice on her.
"It is clear that the full bench has seriously disregarded the constitutional and legal provisions as any case should be sent to the constitutional bench for decision in accordance to Article 133(1) and Article 137 immediately upon seeing there is question of constitutional interpretation," Singh's writ petition argues. "It is an injustice to deprive the applicant of legal remedy by not ordering to send the case with constitutional question to the constitutional bench."
Singh has asked an interim order to not allow implementation of the correspondence done on the basis of the final verdict of that full bench and not remove her from the compound.
