The Supreme Court (SC) on Friday has quashed the contempt of court case against Nepali Congress (NC) President Sher Bahadur Deuba.
A joint bench of Chief Justice (CJ) Om Prakash Mishra and Justice Bam Kumar Shrestha has ordered dismissal of the contempt of court case against NC and Deuba.
Advocate Hari Mainali had filed the case in April 2017 claiming that the NC central committee decision to call SC verdict on appointment of Nepal Police IGP an interference on executive rights of the government tantamount contempt of court.
A bench including the then CJ Sushila Karki had revoked the decision of the then government to appoint Jai Bahadur Chand the IGP.
Advocate Mainali moved the Apex Court making NC and its president Deuba the defendants after the party's central committee officially commented that the SC verdict encroached on executive authority.
The SC conducting the first hearing on the case had instructed the defendants to provide reasons for the party's decision within 10 days.
But lawmakers of NC and the then CPN (Maoist Center) registered an impeachment motion against the then CJ Karki 25 days after that verdict. Deuba has reportedly confided with NC leaders that he registered the impeachment motion against Karki fearing she will jail him on that contempt of court case.
Karki, who was suspended after registration of the motion, had returned to duty after the SC issued an interim order against the motion.
